I don't beleive that the property maintenace code says that it must be grounded, it even says under laundrys that it must be grounded OR have GFI protection. For bathrooms it says that you must have at least one receptacle and any new must be GFI protected. It does not say that they must be grounded.
We know that if a new circuit is installed it must be grounded. For existing if we go to 406.3 D Replacements it says that if an equipment grounding conductort is present we MUST use it. 406.3D3 says that if no equipment ground is present we can install a GFI with a sticker saying no equipment ground present.
With that being said I would alow them to do just that.
